Tempe’s exemption spells out its limits. City Code Chapter 8, section 105.2, exempts replacing an air conditioner unit, furnace, heat pump or evaporative cooler in the same location with one of equal or less BTU, cfm and amperage rating, in a detached single-family home, two-family dwelling or townhome where the appliance serves one dwelling unit.
Step outside those limits and a permit applies. A larger furnace, a heat pump with a higher amperage rating than the equipment it replaces, or a unit moved to a new spot is no longer a like-for-like replacement. That can be the case when a home moves from a gas furnace to a heat pump, because the electrical ratings differ. We’ll tell you whether a permit applies.
Tempe’s code table gives a mean annual temperature of 71.2°F but leaves its Manual J design rows blank, so the city publishes no winter design temperature of its own; a footnote says they are to be filled in from the Phoenix Sky Harbor values in ACCA Manual J or criteria the city sets. The city moved to the 2024 International Codes on July 1, 2026. In a rental, Tempe’s Rental Housing Code requires permanently installed heating, under the tenant’s control, that can heat all habitable rooms and bathrooms to at least 70°F. When a permit does apply, applications go through the Tempe Citizen Access Portal, and the city says inspection requests received before midnight are inspected the following business day.
